Terms of Service

1. Agreement

By creating an account on Nexelead (operated by Devute UK LTD, "we", "us"), you agree to be bound by these Terms.

1a. Beta software

Nexelead is currently in beta. By using the service while it is marked Beta you acknowledge and accept that:

• The software is provided "as is" and may contain bugs, glitches, or temporary outages while we iterate.
• Feature set, UI, API contracts, and pricing may change without notice. We will communicate breaking changes by email when reasonably possible.
• We perform daily backups of customer data but cannot guarantee zero data loss during the beta period.
• You agree not to bring claims arising from issues inherent to beta software, including downtime, performance degradation, missing features, or transient defects.
• Our liability during the beta period is capped at the lower of £100 or fees paid in the prior 30 days (whichever is lower).
• Your UK GDPR rights remain fully in force — right of access (Article 15), right to erasure (Article 17), and retention controls work as documented in our Privacy Policy regardless of beta status.
• You can report bugs at support@nexelead.com or via the contact form. We aim to acknowledge within 2 business days.

We will lift the "Beta" designation when the product reaches general availability. At that point this clause is superseded by the standard liability terms in §7.

2. Subscription & billing

Paid plans are billed monthly via Stripe. You may cancel at any time; the workspace stays active until the end of the paid period.

3. Acceptable use

You must not use Nexelead to send spam, harvest data without consent, or violate any applicable law (including UK GDPR, PECR, CAN-SPAM, GDPR).

4. Data ownership

You own all the lead and customer data you put into Nexelead. We act as a data processor on your behalf.

5. Service availability

We target 99.5% uptime. We do not guarantee uninterrupted service. Scheduled maintenance is announced in-app.

6. Termination

We may suspend or terminate your account for breach of these Terms. Upon termination, you have 7 days to export your data before it is permanently deleted.

7. Liability

To the maximum extent permitted by law, our total liability is capped at the amount you paid in the previous 12 months.

8. Governing law

These Terms are governed by the laws of England and Wales.
